ESPN X GAMES IX SWEEPSTAKES
OFFICIAL RULES
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN, NOR WILL A PURCHASE IMPROVE ONE’S CHANCES OF WINNING

1. SPONSOR: Hollywood Records, Inc., 500 South Buena Vista St., Burbank, CA 91521.

2. ADMINISTRATOR: The Coalition of Independent Music Stores, LLC, 1776 Independence Court, Suite 101, Birmingham, AL , 35216.

3. ENTRY: This Sweepstakes may only be entered in the 50 states and D.C. (“Territory”) in one of the two (2) following ways:
(a) By Internet: During the period commencing at 12:01 A.M., July 10, 2003, and ending at 11:59:59 P.M., August 6, 2003 (“Term”), log on to www.cimsmusic.com, and follow entry instructions. Normal Internet access and usage charges imposed by your on-line service will apply. It is your sole responsibility to notify Administrator in writing if your e-mail address changes. For purposes of these Official Rules (“Rules”), all times and dates are Pacific Time. (“On-line Entry”)
(b) By Deposit: During the Term, complete an official entry form available in the Territory at each of the seventy-three (73) participating member stores (“Store”) of the Administrator, and deposit it in the entry box in a Store. (“Deposit Entry”)

4. LIMITATIONS: All Entries must be received by 11:59:59 P.M., August 6, 2003. Only one Entry per person or e-mail address (regardless of whether one person has more than one e-mail address or more than one person uses the same e-mail address). In event of a dispute regarding the identity of the person submitting an On-Line Entry, the Entry will be deemed to be submitted by the person in whose name the e-mail account is registered. Entries by any e-mail method other than set forth above in Section 3 are void. Any use of automated or programmed methods of effecting entry on-line is prohibited. Open only to persons who are 13 years old or older upon entering and who are legal residents of, and physically located within, the Territory. Employees of Sponsor, Administrator, ESPN, Inc., HARO Bicycles and of any of the Stores; their respective parent, subsidiary and affiliated companies; the advertising, promotional and fulfillment agencies of each of them; (individually and collectively, “Entities”) and members of their immediate families and same households are ineligible. The Entities are not responsible for Entries from persons residing, or physically located, outside the Territory; Entries that are inaccurate, incomplete, tampered with, lost, interrupted, deleted, defective, stolen, destroyed, altered, given unauthorized access to, misdirected, non-delivered, delayed, late or misrouted; any printing, production, technical, electronic or other errors; or for lost, interrupted or unavailable network, server or other connections; miscommunications; failed phone, computer hardware or software or telephone transmissions; technical failures; unauthorized human intervention; traffic congestion; garbled or jumbled transmissions; or other errors of any kind, whether due to electronic, mechanical or human error or other causes; each of which potential Entries will be disqualified. Void where prohibited or restricted by law and subject to all applicable federal, state, local and municipal laws and regulations.

5. PRIZES: One (1) GRAND PRIZE: A three (3) day/ two (2) night trip for two (2) to Los Angeles, CA, (“Trip”) to attend the ESPN X Games IX at the Staples and Los Angeles Convention Centers, Friday, August 15, through Monday, August 18, 2003 (“Event”), consisting of round-trip coach air transportation between the major metropolitan airport nearest winner’s residence and Los Angeles International Airport; airport/hotel transfers; hotel accommodations for two (2) persons (one room) for two (2) nights and two (2) tickets for admission to the Event. Airline carrier’s and hotel regulations and conditions apply. All expenses not specifically mentioned herein are not included and are solely the winner’s responsibility. Winner and guest must be available to make the Trip to attend the Event on the above mentioned dates, or the prize will be forfeited and an alternate winner selected. Approximate retail value (“ARV”): $2,000. Seventy-Three (73) First Prizes (One for each Store): One (1) HARO Nyquist X-1 bicycle (ARV: $300). Total ARV of all prizes: $23,900. Limit one First Prize per person/e-mail address. Prizes are not redeemable for cash or transferable, except to a surviving spouse residing in the same household. No substitutions allowed except, at Sponsor’s sole discretion, a prize of equal or greater value may be substituted. All prizes will be awarded provided a sufficient number of eligible Entries are received.

6. PROCEDURES: Sweepstakes begins at 12:01 A.M., July 10, and ends at 11:59:59 P.M., August 6, 2003. On or about August 7, 2003, in a random drawing at each Store, a First Prize winner for each Store will be selected from all eligible On-Line and Deposit Entries received for that Store. Odds of winning a First Prize for a Store depend on the total number of eligible Entries received for the Store. On or about August 8, 2003, in another random drawing, Grand Prize winner will be selected from all eligible First Prize winners. Odds of winning the Grand Prize depend on the total number of eligible First Prize winners.

7. WINNERS: Each potential winner will be notified by telephone on or about August 8, 2003. All responsibilities of a minor under the Rules will be assumed by parent/legal guardian (“Parent”). Disqualification and the selection of an alternate winner may result from any of the following: (1) the failure of a potential winner to accept the prize immediately upon notification; (2) the return of any phone, fax or e-mail notification as undeliverable after 1 attempt; (3) the failure of a potential winner to execute and return an Affidavit of Eligibility/Liability/Publicity Release within two (2) days from the date of transmission or by the date designated by Administrator; (4) the return of any other notice or prize as undeliverable; (5) the failure of a potential Grand Prize winner to be available to make the Trip and (6) any other non-compliance with Rules. Winner and guest must travel together on the same itinerary; and guest will be required to execute and return a Release of Liability prior to ticketing. Any minor must be accompanied on the Trip by Parent. All taxes are solely the winner’s responsibility. 8. CONDITIONS: Each entrant by entering this sweepstakes agrees that: (1) he/she will abide by and be bound by the Rules and the Sponsor’s decisions; (2) the Entry becomes solely the Administrator’s property and will not be acknowledged or returned; (3) none of the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (“Releasees”) are responsible for claims, injuries, losses or damages of any kind resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize; participation in this Sweepstakes or in any activity or travel related thereto or from computer downloading any Sweepstakes information; (4) the prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose); (5) winner’s acceptance of a prize constitutes the grant of an unconditional right to use winner's name, address (city and state only), voice, likeness, photograph, biographical and prize information and/or statements about the promotion for any publicity, advertising and promotional purposes without additional compensation, except where prohibited by law; (6) in the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Sponsor’s reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of this Sweepstakes, so that it cannot be conducted as originally planned, the Sponsor has the right to cancel, terminate or suspend the Sweepstakes; and in such event, to select winners by random drawing from among all eligible Entries received up to such time of cancellation, termination or suspension and in the event a Trip has already commenced, to terminate the Trip and return the winner and guest to the airport of departure as soon as reasonably possible; (7) the Releasees are not responsible for typographical or other errors in the offer or administration of this Sweepstakes, including but not limited to errors in advertising, the Rules, the selection and announcement of the winners or the distribution of the prizes; (8) any portion of a prize not accepted by the winner will be forfeited and (9) the Releasees are not responsible for any inability of any winner to accept or use any prize (or portion thereof) for any reason.
